Human Rights found a violation of Article 8 of the Convention (right to respect for private and family life). The case concerned a forced adoption and the permanent severance of family ties, in which the applicants were successfully represented by Mr. Grégory Thuan Dit Dieudonné.
The Court criticized the Italian authorities for failing to provide adequate parental support, abruptly suspending contact while proceedings were pending, and refusing to consider significant updates in the parents’ circumstances. Notably, the judgment also recognized the violation of the grandparents’ rights. The Court awarded over 100,000 euros in total damages.
Key Takeaway: The judgment reinforces that the irreversible breakdown of family ties must remain a measure of last resort and, thanks to Mr. Thuan Dit Dieudonné’s defense, clears the path for an immediate and renewed examination of the family’s situation by Italian courts.
